1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Zikar App Ltd, a company registered in England and Wales ("we", "us", "our").

By downloading, installing, or using the Zikar App ("the App"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not download or use the App.

These Terms are governed by the laws of England and Wales and comply with the Consumer Rights Act 2015 and applicable UK consumer protection legislation.

2. The Service

Zikar is a mobile application for Islamic dhikr counting, habit tracking, supplications, and community group features ("the Service"). We offer the following plans:

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We will provide at least 30 days' notice before discontinuing the Service entirely.

Your statutory rights under the Consumer Contracts Regulations 2013 and Consumer Rights Act 2015 are not affected by these Terms.

5. Acceptable Use

You agree not to use the App in any way that:

All user-generated content is also subject to our Content Policy.

6. Intellectual Property

The App, including the Zikar name, logo (ذِكر), app icon, code, design, curated content, and all associated branding, is the exclusive intellectual property of Zikar App Ltd and is protected under UK and international intellectual property law.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not use the Zikar name, logo, or branding for any purpose without prior written consent from Zikar App Ltd.

7. User Content

You retain ownership of any content you create within the App (custom azkaar names, Arabic text, group names). By submitting User Content, you grant Zikar App Ltd a limited, royalty-free licence to store, display, and transmit your content solely for the purpose of operating and improving the App.

You represent and warrant that your User Content does not infringe the intellectual property rights of any third party and complies with our Content Policy.

8. Islamic Content Disclaimer

Zikar App is a technology tool. It is not operated by Islamic scholars, a mosque, or any recognised Islamic religious authority. Nothing within the App should be understood as a fatwa, religious ruling, or authoritative scholarly interpretation.

Pre-loaded azkaar are sourced from recognised collections including Hisnul Muslim, Sahih al-Bukhari, and Sahih Muslim. We do not guarantee the absolute scholarly verification of every piece of content. Users are encouraged to verify azkaar with qualified scholars.

9. Disclaimers and Warranties

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by English law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free from viruses.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015.

10. Limitation of Liability

To the maximum extent permitted by the laws of England and Wales, Zikar App Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Our total liability to you for any claim shall not exceed the amount you paid for your subscription in the three (3) months immediately preceding the claim. Free plan users acknowledge that our total liability is limited to £1.

This limitation does not apply to liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

11. Termination

Termination by You

You may terminate your account at any time via Profile → Account Settings → Delete Account. Termination of a paid subscription is subject to our Refund Policy.

Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice, for breach of these Terms, fraudulent or illegal activity, or repeated violation of our Content Policy. We will provide written notice of termination where reasonably practicable.

Effect of Termination

Upon termination, your licence to use the App immediately ceases. Sections 6, 8, 9, 10, and 12 of these Terms survive termination.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales.

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in another part of the UK, you may also have rights under the laws of Scotland, Northern Ireland, or Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App and by email at least 14 days before they take effect. Continued use of the App after changes take effect constitutes your acceptance.
